WARRANTY
CANADIAN LIMITED WARRANTY FOR AEROTARA-BRANDED PRODUCTS
Aerotara-branded products purchased in Canada come with a 90-day, one-year, two-year or three-year limited warranty. To determine which limited warranty came with your product(s), see your invoice or packing slip.
This limited warranty covers defects in materials and workmanship in your -- our end-user customer's -- Aerotara-branded products.
This limited warranty does not cover:
- Non-Aerotara (third party) branded products
- Problems that result from:
- External causes such as accident, abuse, misuse, or problems with electrical power
- Servicing not authorized by Aerotara
- Usage that is not in accordance with product instructions
- Failure to follow the product instructions or failure to perform preventive maintenance
- Problems caused by using accessories, parts, or components not supplied by Aerotara
- Systems for which we have not received payment
WARRANTIES FOR THIRD PARTY PRODUCTS
Similar to other resellers of pilot supplies, Aerotara does not warrant third-party products directly. Third-party products are covered by the warranties provided by the original publisher or manufacturer only. Third party publisher and manufacturer warranties vary from product to product. Consult your product documentation for specific warranty information. More information may also be available from the publisher or manufacturer.
RETURNS
All claims for damage, errors, or shortages in the merchandise delivered must be made within 48 hours from delivery of the merchandise.
If you are unsatisfied with your purchase from Aerotara Inc., simply return the product within 14 days of purchase to us for an exchange, store credit or a full refund. Software, videos, and textbooks, unless damaged or corrupted, must be returned in the original packaging.
We must be contacted prior to any returns for any reason. When you contact us, we will issue a Return Material Authorization Number for you to include with your return. You must return the products to us in their original packaging, prepay shipping charges, and insure the shipment or accept the risk if the product is lost or damaged in shipment. Everything included with the product must be returned including unfilled warranty cards and unused manuals. We will return the repaired or replacement products to you. We will pay to ship the repaired or replaced products to you if you use an address in Canada. Otherwise, we will ship the products to you freight collect. If we determine that the problem is not covered under this warranty, we will notify you and inform you of service alternatives that are available to you on a fee basis. All returns must have our RMA form filled out, to get this form please contact us.

LIMITATION OF LIABILITY
AEROTARA DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. EXCEPT AS EXPRESSLY PROVIDED HEREIN, AEROTARA WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, AEROTARA IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, THE REMEDIES SET FORTH IN THIS AGREEMENT SHALL APPLY EVEN IF SUCH REMEDIES FAIL THEIR ESSENTIAL PURPOSE.
CORPORATE CUSTOMERS - Shipping Charges; Taxes; Title; Risk of Loss.
Shipping and handling are additional unless otherwise expressly indicated at the time of sale. Title to products passes from Aerotara to Customer on shipment from Aerotara's facility. Loss or damage that occurs during shipping by a carrier selected by Aerotara is Aerotara's responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. You must notify Aerotara within 7 days of the date of your invoice or acknowledgement if you believe any part of your purchase is missing, wrong or damaged. Unless you provide Aerotara with a valid and correct tax exemption certificate applicable to your purchase of Product and the Product ship-to location, you are responsible for sales and other taxes associated with the order. Shipping dates are estimates only.
GOVERNING LAWS
This Agreement and its performance shall be governed by the laws of the Province of Ontario, Canada. You consent and submit to the exclusive jurisdiction of the courts located in the City of Ottawa, in the Province of Ontario, Canada, in all disputes arising out of or relating to the use of these Terms and Conditions.
